Pauzeradio is operated by Gav Pauze trading as Pauzeradio.

By creating an account, using Pauzeradio, submitting material, requesting a service or purchasing an accepted service, you agree to these Terms & Conditions.

Nothing in these Terms removes or restricts any statutory rights you have under applicable UK consumer law.

3. Minimum age

You must be 18 years of age or older to create a Pauzeradio account.

By registering for an account, you confirm that you are at least 18 years old.

Pauzeradio may suspend or close an account where we reasonably believe the account holder is under 18.

4. Pauzeradio accounts

Pauzeradio currently provides three principal account types. An account may have more than one role where the user uses different Pauzeradio services.

Reader / Listener accounts are private accounts intended for people who consume Pauzeradio content. They may be used to:

  • access free downloads;
  • download radio shows and other free content;

  • other services offered by Pauzeradio.

5. Private profiles

Pauzeradio account profiles are private. Depending on the account, users may be able to provide information such as an avatar, name or display name, biography, website, Instagram, Facebook, X, YouTube, SoundCloud, Mixcloud and other profile information.

Adding information to a private account profile does not publish that information publicly. Private account profiles may only be viewed by the account holder and authorised Pauzeradio administrators.

Material supplied separately for publication is dealt with under the submission provisions in these Terms.

6. Account security

Users are responsible for keeping their account credentials secure. You must not:

  • knowingly allow another person to misuse your account;
  • impersonate another person;
  • obtain an account through false information;
  • attempt to access another person's account;
  • interfere with Pauzeradio's security systems;
  • bypass account restrictions; or
  • use automated systems to manipulate Pauzeradio services.

You should contact Pauzeradio if you believe your account has been compromised.

7. Account activity

Pauzeradio may maintain private records of activity carried out through an account, including votes, voting history, downloads, download history, advertising activity, service submissions, orders, campaign activity, submission status, payment status, and dates associated with those activities.

This information may be displayed to the account holder within their private account dashboard. It is not publicly visible. Further information is available in our Privacy Policy.

8. Chart voting

Reader / Listener accounts may vote in Pauzeradio charts and rating systems where voting is available. Votes must represent genuine user activity.

Users must not attempt to manipulate Pauzeradio voting through:

  • multiple fraudulent accounts;
  • automated voting;
  • scripts or bots;
  • deliberately circumventing voting restrictions;
  • fraudulent voting activity; or
  • other artificial means.

Pauzeradio may use account and technical information to help identify duplicate or manipulated voting. Pauzeradio reserves the right to remove or invalidate votes where we reasonably believe they are fraudulent or have been manipulated. Serious or repeated abuse may result in account restriction, suspension or closure.

Voting does not guarantee that an artist or release will achieve any particular rating, position or chart result.

9. Free downloads

Pauzeradio may make selected radio shows and other promotional content available to registered users as free downloads. Pauzeradio does not charge users to access these downloads and does not sell the music contained within them. Free downloads are provided for personal and non-commercial listening.

Users must not:

  • sell Pauzeradio free downloads;
  • commercially redistribute them;
  • re-upload them for public distribution;
  • make them available through commercial download services;
  • extract music from them for redistribution; or
  • otherwise commercially exploit them without appropriate permission.

Copyright and ownership in music contained within Pauzeradio programming remains with the relevant artists, writers, producers, labels and other rights holders. The fact that Pauzeradio provides a download free of charge does not remove any copyright requirements that may apply to copying, distribution or making copyright works available online.

10. Music supplied to Pauzeradio

Music featured by Pauzeradio is supplied by artists, producers, labels, promoters or other authorised representatives for promotional use, airplay and editorial coverage, or is otherwise used with appropriate permission.

Music may be supplied to Pauzeradio in formats including digital audio files, MP3 files, CDs, vinyl records, promotional links and other promotional media.

Material supplied to Pauzeradio for promotional use may be considered for radio airplay, Pauzeradio radio shows, editorial coverage, reviews, related promotional content and other appropriate Pauzeradio coverage. Receipt of promotional music does not guarantee airplay, review, publication or other coverage. Pauzeradio retains editorial control over what music it features.

11. Promotional music supplied to Pauzeradio is not sold

Pauzeradio does not sell or commercially redistribute promotional MP3s, CDs, vinyl records or other source material supplied to Pauzeradio by artists, producers, labels or promoters. Promotional source files are not made available to Pauzeradio users simply because they have been supplied to Pauzeradio.

Where a Pauzeradio radio show containing promotional music is made available as a free download, the download is provided as part of Pauzeradio's promotional radio and editorial service and is not sold to the listener.

12. Music submitted for reviews

Music submitted to Pauzeradio for review must be submitted by the artist, a rights holder, a record label, a producer, an authorised promoter, an authorised representative, or another person with authority to make the submission.

By submitting a release for review, the person making the submission confirms that they have authority to provide the music and information to Pauzeradio for the requested promotional and editorial purpose. The submitter grants Pauzeradio permission to identify, discuss and promote the submitted music in connection with the resulting review and related Pauzeradio content.

Ownership and copyright in the music remain with the relevant rights holders. Granting Pauzeradio permission to use material does not transfer copyright ownership to Pauzeradio.

13. YouTube on content pages

Where Pauzeradio features music on review, editorial, artist or other content pages, Pauzeradio may link to or embed an authorised version of the music available through YouTube. The original music file supplied to Pauzeradio for promotional purposes is not made available to website visitors through the review page.

YouTube operates as a third-party service and use of YouTube is also subject to Google's and YouTube's applicable terms and policies.

14. DJ programme submissions

DJ Contributor accounts allow approved contributors to submit completed radio programmes to Pauzeradio. A DJ submission may include audio, playlists, tracklists, titles, descriptions, artwork, links and programme information.

Submitting a programme does not publish it automatically. Pauzeradio reviews all submitted programmes and decides whether, when and how they are published.

15. DJ music permissions

DJs and contributors must only submit programmes containing music they reasonably understand to have been supplied or authorised for the relevant promotional, radio or editorial use.

Music used within Pauzeradio programmes is generally supplied to Pauzeradio or its contributors by artists, producers, labels, promoters or other authorised representatives for promotional use and airplay. By submitting a programme, the contributor confirms, to the best of their knowledge, that they are authorised to submit the programme to Pauzeradio for consideration.

Pauzeradio may reject or remove a programme where a legitimate copyright or rights issue is raised.

16. Storage of DJ submissions

DJ-uploaded files are stored on Pauzeradio's website servers while awaiting editorial review. If a programme is accepted, the relevant files may be moved into Pauzeradio's live website files for publication and delivery. If a programme is rejected or considered unsuitable, submitted files may be deleted. Pauzeradio is not required to retain rejected submissions indefinitely.

17. Editorial control

Pauzeradio retains full editorial control over all material appearing on Pauzeradio.com. This includes radio shows, reviews, biographies, press releases, event listings, advertising, artwork, editorial articles and other published content.

Nothing submitted through a Pauzeradio account automatically becomes public. Pauzeradio may approve, reject or request reasonable changes to submitted material.

18. Paid services

Pauzeradio may offer paid services including:

  • Advertising — website advertising and campaign placement.
  • Music Reviews — independent Pauzeradio-written reviews of singles, EPs and albums.
  • Artist Biographies — publication of customer-supplied artist biography material.
  • Press Releases — publication of customer-supplied press releases.
  • Event Listings — Standard and Spotlight event listings based on information supplied by the customer.

The current service description and price shown on Pauzeradio when a request is made forms part of the service offered.

19. Paid submissions are reviewed before payment

Submitting material for a paid Pauzeradio service is initially a submission for approval. It is not an automatic purchase. The process is:

  1. The customer selects the required service.
  2. The customer submits the required information and material.
  3. Pauzeradio reviews the submission.
  4. Pauzeradio decides whether it is suitable.
  5. If accepted, the customer is invited to make payment.
  6. Payment is processed through Stripe.
  7. Pauzeradio provides or schedules the accepted service.

Customers are not charged when they initially submit material. If Pauzeradio declines the submission before approval, the customer is not charged.

20. Submission does not guarantee acceptance

Pauzeradio may decline a submission that is incomplete, misleading, factually unreliable, defamatory, unlawful, discriminatory, abusive, infringing, technically unsuitable, unrelated to Pauzeradio, inconsistent with Pauzeradio editorial standards, or otherwise considered unsuitable for publication.

Pauzeradio may also request amendments before accepting a submission. Payment is not requested until Pauzeradio has accepted the submission.

21. When the paid contract begins

Submitting material for approval does not itself create a paid service contract. Where Pauzeradio accepts the submission, the customer will be invited to pay the applicable price. Unless explicitly agreed otherwise, the paid contract is formed when the customer successfully completes payment for the service accepted by Pauzeradio.

22. Payments

All Pauzeradio payments are processed through Stripe. Pauzeradio does not collect, hold or store customers' full payment-card or banking information. Financial details are entered into and processed through Stripe's systems.

Pauzeradio may receive limited transaction information necessary to operate its services, including customer name, service, amount, payment date, payment status, Stripe transaction reference, and refund or cancellation status.

23. Music reviews

Pauzeradio music reviews are independently written by Pauzeradio. Payment purchases the review service. Payment does not purchase a favourable review, a particular opinion, a particular rating, a particular chart position, a specific score, or editorial control over the review.

Pauzeradio writers remain free to give their genuine editorial assessment. A customer is not entitled to a refund simply because they disagree with the review or would have preferred a more favourable opinion. Pauzeradio may correct genuine factual errors where appropriate.

24. Review submission packages

Different review packages may be offered for singles, EPs and albums. The package descriptions, track limits and prices displayed on the Pauzeradio service page when the submission is made will apply.

Customers must accurately state the number and type of tracks submitted. Pauzeradio may require the customer to select a different package where the submitted material does not meet the package originally selected.

25. Biography submissions

Biography listings are based primarily on text supplied by the customer. Unless Pauzeradio expressly offers a separate writing service, the customer is responsible for providing a complete biography ready for publication. Where the service page specifies a minimum length, including the current minimum of 500 words, the submission must meet that requirement.

The customer is responsible for factual accuracy, names, dates, credits, claims, website links and social-media links. Pauzeradio may make reasonable spelling, formatting, grammar and presentation corrections without changing the substantive meaning of the submission.

26. Press release submissions

Press release listings are based on material supplied by the customer. Unless otherwise agreed, the submitted release should be complete and ready for publication and meet any minimum length specified on the service page, including the current minimum of 500 words.

The customer is responsible for the accuracy of names, dates, quotations, credits, claims, links, release information and other factual statements. Pauzeradio may make minor spelling, formatting and presentation changes.

Publishing a press release does not mean that Pauzeradio authored or independently endorses every claim contained within customer-supplied material.

27. Event listings

Pauzeradio may offer different levels of event listing, including Standard and Spotlight listings. Customers must provide accurate information including, where relevant, event title, venue, town or city, date, start time, performers or DJs, genre, ticket links, website links, social-media links, event description, and flyer or artwork.

Customers are responsible for notifying Pauzeradio of material changes where reasonably possible.

28. Spotlight event listings

A Spotlight Event Listing provides the additional visibility or placement described on the service page. Spotlight status does not guarantee ticket sales, attendance, website traffic, social-media engagement, commercial success, or any particular audience response.

29. Event responsibility

Unless Pauzeradio expressly states that it is organising an event itself, Pauzeradio is acting only as the publisher of the listing. Pauzeradio is not responsible for independently organised events, including cancellation, postponement, venue changes, ticketing issues, performer changes, admission decisions, or the conduct of organisers or attendees.

Users should check current information with the event organiser or ticket provider before travelling.

30. Advertising

Advertising packages provide the placement and duration described on the relevant Pauzeradio advertising page. Pauzeradio does not guarantee any particular number of impressions, clicks, conversions, enquiries, sales, streams, downloads, audience growth, or financial return.

Advertisers are responsible for ensuring that their advertising material and claims comply with applicable laws and advertising requirements. Pauzeradio may refuse or remove advertising where it reasonably considers the advertisement misleading, unlawful, infringing or unsuitable.

31. Customer-supplied material

Customers and contributors may supply Pauzeradio with text, photographs, artwork, logos, flyers, audio, video links, biographies, press releases, promotional copy, website links and other material.

You retain whatever ownership rights you already hold in your original material. By submitting it for a Pauzeradio service, you grant Pauzeradio a non-exclusive permission to host, reproduce, resize, format, display and publish the material as reasonably necessary to provide the requested service and operate the resulting Pauzeradio content. This does not transfer ownership of the submitted material to Pauzeradio.

32. Permission to submit material

By submitting material, you confirm that you own it, or you have permission from the relevant rights holder, or you are otherwise authorised to provide it for the intended purpose.

You must not knowingly submit material that infringes another person's copyright, trade mark, privacy or other legal rights.

33. Information and images concerning other people

Submissions may contain information about other people, such as artist biographies, photographs, band member information, performer names, quotes, event information and contact details.

The person making the submission is responsible for having the appropriate authority to supply this material where required. Pauzeradio may ask for clarification or evidence where a rights or privacy concern arises.

34. Removal of submitted or published material

Pauzeradio may remove or amend published material where a legitimate copyright claim is raised, a legitimate privacy complaint is raised, information is shown to be materially inaccurate, the content becomes unlawful, permission is withdrawn where legally relevant, continued publication creates a legal or security risk, or Pauzeradio otherwise has reasonable grounds to remove it.

Requests will be considered according to the circumstances and applicable law.

35. Consumer cancellation rights

Where a customer is acting as a UK consumer and purchases a Pauzeradio service online, statutory cancellation rights may apply. For many online service contracts, the starting position is a 14-day cancellation period. Different rules may apply where the consumer expressly asks Pauzeradio to begin providing the service during that period, and the cancellation right may end once the service has been fully performed following the required request and acknowledgement.

Pauzeradio does not intend these Terms to remove any cancellation right that applies by law.

36. Starting work within the cancellation period

Some Pauzeradio services may reasonably begin shortly after payment. Where Pauzeradio intends to begin supplying a consumer service before the applicable 14-day cancellation period has expired, the customer may be asked to expressly request that work begins during that period.

If the customer then cancels after work has begun but before the service has been completed, consumer law may permit Pauzeradio to charge an appropriate proportion for the service already supplied. Where the service is fully performed following the customer's express request and required acknowledgement, the statutory cancellation right may end.

37. Checkout acknowledgement for early service

Where required, Pauzeradio may use a separate checkout confirmation such as:

"I request Pauzeradio to begin providing this service during the 14-day cancellation period. I understand that once the service has been fully performed, I will lose my statutory right to cancel."

This confirmation is separate from optional marketing consent.

38. Refunds

If Pauzeradio accepts payment but is unable to provide the agreed service, an appropriate refund will be provided. Any statutory consumer cancellation or refund rights continue to apply.

A refund will not normally arise merely because a review was less favourable than the customer hoped, advertising did not achieve the customer's preferred result, an event did not achieve expected attendance, a Spotlight listing did not generate expected traffic, customer-supplied information was incorrect, or the customer changes their mind after an agreed service has been fully provided and any applicable cancellation right has ended.

Nothing in these Terms removes statutory rights relating to services that must be provided with reasonable care and skill.

39. Corrections

Pauzeradio will consider reasonable requests to correct genuine factual errors in published material. This does not give a customer editorial control over a Pauzeradio-written review, an editorial opinion, a rating, criticism, chart results, or other genuine editorial judgement.

40. Published material after account deletion

Deleting the private account used to make a submission does not necessarily automatically delete material that has already been separately approved and published by Pauzeradio. Published content may form part of Pauzeradio's editorial archive.

Requests concerning personal information contained within published material will be considered in accordance with applicable law and the Pauzeradio Privacy Policy.

41. Account deletion

Users can delete their Pauzeradio account using the self-service account deletion function. Once deletion is completed, the account cannot be recovered. Associated private profile and account data will be deleted in accordance with the Privacy Policy.

Pauzeradio may retain limited information where necessary for legal obligations, accounting, tax, fraud prevention, security, disputes, or legal claims.

42. Suspension and termination

Pauzeradio may suspend or close an account where reasonably necessary because of fraud, abusive behaviour, vote manipulation, security threats, unlawful activity, attempted unauthorised access, serious misuse of Pauzeradio, repeated violation of these Terms, or deliberate interference with Pauzeradio systems.

Where appropriate, Pauzeradio may first give the account holder an opportunity to resolve the issue.

43. Pauzeradio intellectual property

Unless otherwise stated, Pauzeradio's original name and branding, logos, site design, articles, written reviews, graphics, editorial text, photographs owned by Pauzeradio, and other original Pauzeradio content are owned by or licensed to Pauzeradio.

Users must not reproduce or commercially exploit Pauzeradio-owned material without permission except where permitted by law. Third-party music, artwork, photographs, logos and other material remain subject to their respective rights holders' rights.

44. Availability of the website

Pauzeradio aims to keep the website and services available and functioning correctly. However, uninterrupted access cannot be guaranteed. The website may occasionally be unavailable because of maintenance, updates, hosting problems, technical faults, network problems, security incidents, or circumstances outside Pauzeradio's reasonable control.

45. Paid advertising during outages

Where a significant Pauzeradio technical outage materially prevents an advertising placement from being delivered for an agreed period, Pauzeradio may provide an appropriate remedy such as an extension of the campaign. The appropriate remedy will depend on the circumstances and any statutory rights that apply.

46. Third-party websites

Pauzeradio contains links to websites operated by third parties, including artists, labels, ticket providers, event organisers, social-media platforms, YouTube, and other external services. Pauzeradio does not control independent third-party websites and is not responsible for their content, availability, security or separate business practices merely because Pauzeradio links to them.

47. YouTube embeds

Pauzeradio may embed YouTube videos in editorial and promotional content. YouTube is operated independently of Pauzeradio. Use of YouTube may be subject to YouTube's own terms, privacy practices and cookies or similar technologies. Further information about third-party technologies is provided in the Pauzeradio Privacy Policy and Cookie Policy.

48. Email communications

Pauzeradio may send necessary communications concerning account registration, account security, submissions, approvals, payments, orders, campaigns, DJ submissions, and services requested by the user. These service communications are separate from optional promotional marketing.

Users will not be required to agree to promotional marketing merely to maintain a Pauzeradio account or use a service.

49. Changes to Pauzeradio services

Pauzeradio may introduce, change or discontinue website features or services. Changes to future services and prices do not retrospectively alter an existing paid contract. Where a material change prevents Pauzeradio from supplying an already-paid service, an appropriate remedy will be offered.

50. Liability

Nothing in these Terms excludes or restricts liability where doing so would be unlawful. Nothing in these Terms excludes statutory consumer rights that cannot lawfully be excluded.

Pauzeradio is not responsible for losses that were not reasonably foreseeable as a result of a breach. Where a customer is acting wholly or mainly for business purposes, Pauzeradio will not be responsible for indirect business losses such as loss of anticipated profit, revenue or business opportunity, except where liability cannot legally be excluded.

51. No guarantee of commercial results

Pauzeradio provides editorial, promotional, advertising and publishing services. Unless specifically stated otherwise, Pauzeradio does not guarantee that using those services will result in record sales, streams, downloads, chart success, radio airplay elsewhere, media coverage elsewhere, event attendance, ticket sales, website traffic, advertising conversions, social-media growth, or other commercial success.

52. Complaints

If you experience a problem with Pauzeradio, an account, a payment, a submission or a service, please contact: [email protected]

Please provide enough information for Pauzeradio to identify the relevant account, transaction or submission. We will consider complaints reasonably and fairly.

53. Privacy

Use of Pauzeradio is also subject to the Pauzeradio Privacy Policy, which explains how Pauzeradio handles personal information, including accounts, private profiles, downloads, voting, account activity, DJ submissions, service submissions, payments, analytics, and account deletion.

54. Cookies

Pauzeradio's use of cookies and similar technologies is explained separately in the Pauzeradio Cookie Policy. Where required, non-essential technologies are subject to appropriate consent controls.

55. Changes to these Terms

Pauzeradio may update these Terms where necessary to reflect changes to the website, new services, technical changes, operational changes, or changes in applicable law.

The latest version will be available on Pauzeradio.com and will show the date it was last updated. Where a significant change materially affects an existing account or service relationship, Pauzeradio may provide additional notice where appropriate.

56. Governing law

These Terms are governed by the laws of England and Wales. Consumers elsewhere in the United Kingdom continue to benefit from mandatory consumer protections that apply to them and may have rights to bring proceedings in their own part of the United Kingdom.

57. Severability

If any part of these Terms is found to be invalid, unlawful or unenforceable, the remaining provisions will continue to apply.

58. Entire agreement

These Terms, together with any service-specific information provided to the customer, the Privacy Policy and any applicable submission conditions, form the agreement governing use of Pauzeradio and its services.

Nothing in these Terms overrides statutory rights that cannot legally be excluded.
